GrowChat provides tools for:
- WhatsApp Business messaging
- Bulk messaging campaigns
- Customer communication management
- Messaging automation
- Contact management
- Reporting and analytics
We reserve the right to modify, suspend, or discontinue any part of the platform at any time without prior notice.
03 Account Registration
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activities occurring under your account.
- Providing accurate and up-to-date information.
You must notify us immediately of any unauthorized use of your account.
04 Acceptable Use
You agree not to use GrowChat for:
- Spam or unsolicited communications.
- Fraudulent, deceptive, or misleading activities.
- Harassment, abuse, or unlawful communications.
- Distribution of malware, viruses, or harmful code.
- Promotion of illegal products or services.
- Violations of WhatsApp Business Platform policies.
- Activities that infringe intellectual property rights.
GrowChat reserves the right to suspend or terminate accounts engaged in prohibited activities without notice.
05 Customer Data & Consent
You are solely responsible for:
- Obtaining valid consent from recipients before sending messages.
- Maintaining proof of consent where required by law.
- Ensuring compliance with applicable privacy and marketing regulations.
GrowChat does not verify recipient consent and assumes no liability for customer messaging practices.
06 WhatsApp & Meta Compliance
GrowChat operates through the WhatsApp Business Platform and related Meta services. You acknowledge that:
- WhatsApp may approve or reject message templates.
- WhatsApp may restrict or suspend messaging accounts.
- Meta policies may change at any time.
- Message delivery is subject to WhatsApp platform rules.
GrowChat is not responsible for actions taken by Meta or WhatsApp against customer accounts.
07 Fees & Payments
Customers agree to pay all applicable fees for:
- Subscription plans
- Messaging credits
- Additional platform services
All payments are due in advance unless otherwise agreed. Failure to make payment may result in suspension or termination of services.
08 Refunds
Refunds are governed by the GrowChat Refund Policy. By using the platform, you acknowledge and agree to the terms of the applicable Refund Policy.
09 Service Availability
While we strive to provide uninterrupted service, GrowChat does not guarantee:
- Continuous platform availability
- Error-free operation
- Uninterrupted message delivery
Service interruptions may occur due to maintenance, technical issues, third-party outages, or factors beyond our control.
10 Intellectual Property
All platform content, software, branding, logos, designs, and materials are the property of GrowChat and Croissance Digital unless otherwise stated.
You may not:
- Copy
- Modify
- Reverse engineer
- Distribute
- Resell
any part of the platform without prior written permission.
11 Data Protection
We process personal information in accordance with our Privacy Policy. By using GrowChat, you consent to the collection and processing of information as described in the Privacy Policy.
12 Limitation of Liability
To the maximum extent permitted by law, GrowChat and Croissance Digital shall not be liable for:
- Indirect or consequential damages.
- Loss of profits or revenue.
- Business interruption.
- Data loss.
- Loss arising from WhatsApp account restrictions or suspensions.
- Message delivery failures caused by third-party systems.
Our total liability shall not exceed the amount paid by the customer for services during the preceding three (3) months.
13 Indemnification
You agree to indemnify and hold harmless GrowChat, Croissance Digital, employees, partners, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:
- Your use of the platform.
- Violation of these Terms.
- Violation of applicable laws.
- Unauthorized or unlawful messaging activities.
14 Suspension & Termination
GrowChat may suspend or terminate your account if:
- You violate these Terms.
- You fail to pay applicable fees.
- Your activities pose a risk to the platform, users, or third parties.
- Required by law or regulatory authorities.
Termination does not relieve you of any outstanding payment obligations.
15 Third-Party Services
GrowChat may integrate with third-party providers, including:
- WhatsApp Business Platform
- Meta Platforms
- Payment gateways
- CRM systems
- Cloud hosting providers
We are not responsible for the availability, functionality, or policies of third-party services.
16 Changes to Terms
GrowChat reserves the right to modify these Terms & Conditions at any time. Updated versions will be published on our website. Continued use of the platform following any changes constitutes acceptance of the revised Terms.
